The General Conditions of Sale apply without restrictions or reservations to all sales of products appearing in our catalog published on the Site, excluding purchases made directly from our PICKUP ATTITUDE physical establishments.

Placing an order through the Site implies your unreserved acceptance of the General Conditions of Sale. To this end, You confirm that you accept all of the General Conditions of Sale when You check the box “I accept? when placing your order. We reserve the right to modify these General Conditions of Sale at any time. We therefore invite You to carefully read the General Conditions of Sale for each new order placed. The applicable General Conditions of Sale will be those in force on the day the order is placed.

The General Conditions of Sale are accessible at any time on the Site and take precedence over any other version or any other contradictory document.

2. Your order

Ordering the products that You select (hereinafter the “Products” ) will be carried out according to the process described below.

Your identification:

You access the contents of your basket, including all the Products. You must then proceed to your identification. As such, You undertake to provide Us with accurate and reliable information, thus enabling Us to execute all of our contractual obligations. We cannot be held liable in the event that the information You have provided proves to be false or incomplete. In this context or in the event of non-payment or any other irregularities on your account, We reserve the right to cancel your order and/or delete your user account. Your identification can be carried out directly after selecting the Products or through your user account (hereinafter the "Account" ). Opening an Account includes entering two identifiers: an email address and choosing a password. Your identifiers are personal to you and must be kept confidential.

Placing your order:

Once the products have been selected and your identification data has been entered, you then proceed to select your payment method.

Final confirmation of your order:

Once the order has been validated, two situations must be distinguished:
1 – In the event of payment by credit card or Paypal: the final validation of your order will take place when the bank debit authorization has been given to Us, i.e. within a maximum period of ten (10) days. A final confirmation will then be sent to you, listing all the elements relating to your order.
2 – In the event of payment by bank or postal check: a confirmation of your order will be sent to you after validation of your order. Only the final validation of the order commits Us contractually to You.

Product availability:

The items are offered to you while stocks last. Thus, in the event of unavailability of the Product ordered, We undertake to inform You as soon as possible and will reimburse the Product (shipping costs included) within a maximum period of 30 days.

3. Product prices

The prices indicated on the Site are indicated “All Tax Included” (TTC), and take into account the possible cost of waste disposal (the eco-contribution).

4. Payment for your order

In case of late payment

In accordance with the regulations in force, any sum not paid by the due date by any professional will give rise to a fixed penalty for recovery costs in the amount of forty (40) euros which will be automatically cumulated with that of late penalties. indicated on your invoice.

5. Security of your payment methods

In order to guarantee maximum security when ordering, all bank card payments are secured by the world-famous PAYPAL system. This system is based on proven cryptography techniques, thus ensuring the confidentiality and integrity of exchanges. 6. Delivery of your order

Shipping

Different shipping costs depending on the size and type of products for Continental France, contact us for other destinations including Corsica and Drom Tom.

Delivery by parcel post

For Products whose weight does not exceed thirty kilograms (30 kg) and/or whose dimensions do not exceed one meter and fifty (1 m), delivery will be made by postal parcel, delivered directly to your home.

If you are absent on the day of delivery, a notice will be left in your mailbox, inviting you to come and collect the Product from your post office.

Delivery by carrier

For Products whose weight exceeds thirty (30) kilograms and/or whose dimensions exceed one meter and fifty (1 m), delivery will be made by means of a carrier that we have designated.

Delivery means leaving the Product in front of your home or at the foot of your building. No handling and installation operations will be carried out by the carrier. You will therefore be responsible for recovering, storing and installing the Products at your home.

Only the carrier is authorized to decide on the most suitable place for unloading. It is specified that delivery will be made to the property boundary. No unloading at height can be carried out (on a slab for example).

In the event that the actual configuration of the delivery location physically prevents the unloading of the goods, the carrier reserves the right to cancel the delivery. In this case, delivery costs will remain your responsibility. 7. Compliance of your order

You must open your order and verify it. To this end, you will sign a delivery or transport slip. You will be able to issue the necessary reservations, detailed, legible, as precise as possible in the event of anomalies noted (breakages; damage; non-compliance: Product error, different color and/or dimensions; missing items, etc.). In this case, You will have to refuse delivery of the package.

If the anomaly is proven, We will implement all necessary means to ensure that a new delivery takes place as quickly as possible.

Before the first use or start-up of the Product, We expressly recommend that You carefully read the instructions and documents attached to the Products. Where applicable, We remind You of the importance of wearing personal protective equipment when using the Products. We will not be held responsible for damage resulting from use of the products that does not comply with the requirements provided for in the instructions and documents attached to the products.

8. Right to withdraw

Conditions for exercising the right of withdrawal.

In accordance with current regulations, for any Product purchase made on the Site, You have a withdrawal period of seven (7) days from receipt of the goods, allowing You to totally or partially cancel their orders .

In order to facilitate the management of product returns and to ensure the transport of the Products in the best conditions, the Products must be returned in their original packaging, accompanied by all accessories and instructions, be in good condition, and accompanied by their invoice.

Repayment Terms

In accordance with legal provisions, We undertake to reimburse You for all amounts paid (shipping costs included), within a maximum period of thirty (30) days.

In the event of initial payment by credit card, You will be re-credited with the amount directly to your credit card.

In the event of initial payment by postal or bank check, We will contact You to obtain a bank identity statement. The transfer will then be made directly to your bank account.

9. Return of the goods

In addition to the right of withdrawal available to You, We allow You to return your purchases for an additional period of three (3) days, from the end of the withdrawal period as specified above.

In this context, the return being made outside the withdrawal period as set by law, only the price of the Product, not including shipping costs, will be refunded to You. Return costs will also be your responsibility.
Apart from taking into account shipping costs, your order will be reimbursed under the same conditions as those described in the previous article.

10. Guarantees – after-sales service

Contractual guarantees granted

The contractual guarantees relating to the Products, and their conditions of application, are set by the supplier of the Product. The contractual guarantees are therefore likely to be different (duration, scope, etc.) depending on the Products, suppliers and brands. You will find details of these guarantees on the Product presentation sheet, attached to the Product, and specified in the instructions for use or any other document accompanying the Product.
The warranty period begins to run from receipt of the Products.
In general, we inform you that the following are not covered by the contractual guarantee offered by the suppliers:
– Malfunctions linked to improper use and/or lack of maintenance of the product.
– Malfunctions linked to normal wear and tear of the Products and the replacement of accessories, wearing parts and consumables.
– Damage linked to various shocks caused to products.
Routine maintenance operations (draining, adjustments, sharpening, etc.) are not covered by the contractual guarantee offered by the suppliers.
Regardless of the contractual guarantee granted, the Products remain guaranteed under the legal guarantee of conformity and the legal guarantee of defects as defined in articles L.211-4 et seq. of the Consumer Code and 1641 et seq. of the Civil Code.

Customer service

We provide after-sales service for our products. We will then provide you with an initial diagnosis (application or not of the contractual guarantee, breakdown, etc.).
After-sales service can be carried out directly in store or by returning the Product.
As part of a return of a Product, and at the end of the diagnosis that We have carried out, if the problem linked to the Product is covered by the supplier's contractual guarantee, a return slip will be sent to You, allowing You to contact Us the Product, free of charge. The repairs will then be carried out and the Product will be returned to You, without You incurring any additional costs.
However, if the warranty is not applicable, a repair estimate will be sent to You. If You accept the quote sent, You must inform Us of Your acceptance. In this case, the return of the Product will be at your sole expense.

11. Abusive use

Our liability cannot be incurred when You do not comply, in whole or in part, with the General Conditions of Sale, or in the event of an unforeseeable act of a third party or in the event of force majeure.

We can in this case exempt ourselves from all or part of our liability by providing proof of the non-performance or poor execution of these General Conditions of Sale, either when this is attributable to You or, when it is an unforeseeable event. and insurmountable by a third party to the contract or following a case of force majeure recognized as such by case law.

12. Retention of title

The delivered goods remain our property until full payment of their price. Failure to pay may result in the goods being claimed.
The transfer of risks of loss or deterioration nevertheless occurs in your hands from delivery of the products.

14. Applicable law and competent court

In the event of a dispute, an amicable solution will first be sought. The search for an amicable solution does not interrupt the contractual guarantee but interrupts the action periods from which You benefit.
